House Bill Number 38 aims to make criminal offenses involving airbags a state jail felony. Currently, these offenses are listed as Class A Misdemeanors. If passed, the penalty range for these crimes would be expanded if the offense in question were to result in a death. The bill would take effect on September 13th of 2013, and would affect all offenses on or after the date. Last year, there were less than ten persons incarcerated or under community supervision for offenses involving motor vehicle airbags. It is not a common offense, but perhaps warrants an increase in penalty. It has been determined that there is no projected state fiscal impact at this time.
