House Bill Number 33 has been approved, and will take place on September 1st of this year. The bill proposes alternate methods of dispute resolutions between department licensed assisted living facilities and the Department of Aging and Disabilities Services itself. The Health and Human Service Commission has been instructed to establish a dispute resolution process by which to handle such issues between organizations when they come up. A statement of violations must be presented.
This informal dispute resolution process requires the assisted living facility to request formal dispute resolution within ten days after their notification of the violation. It also requires that the Health and Human Services Commission complete this process within 90 days after receiving such a request. It makes copies of all information regarding the dispute required to made and given to the department. It elaborates on this requirement greatly, assigning stringent process and rules. An impartial third party must be present to negotiate and solve these conflicts.
